Mac Imagery ("Mac Imagery", "we", "our" or "us").


These Terms of Service ("Terms") govern your access to and use of the Mac Imagery website, online galleries, print store, digital downloads, photography services and any other products or services provided by Mac Imagery.


By accessing our website, making an enquiry, booking our services, purchasing products or otherwise using our website or services, you acknowledge that you have read, understood and agree to be bound by these Terms.


Where you enter into a separate Client Agreement with Mac Imagery, that agreement forms part of the contractual relationship between you and Mac Imagery.


1. Our Services

Mac Imagery provides professional photography services including, but not limited to:

  • Family & Portrait Photography
  • Commercial Branding Photography
  • Product Photography
  • Corporate Photography
  • Real Estate Photography
  • Architectural Photography
  • Drone Photography & Videography
  • Floor Plans
  • Virtual Tours
  • Fine Art Photography
  • Digital Image Licensing
  • Professional Print Sales
  • Photography Workshops
  • Other photography-related services offered from time to time.


2. Photography Agreements

Certain photography services require the Client to enter into a separate written agreement.


These may include, but are not limited to:

  • Family Portrait Photography Agreement
  • Commercial Branding & Product Photography Agreement
  • Real Estate Photography Agreement
  • Any project-specific agreement issued by Mac Imagery.


Where a separate agreement exists, it takes precedence over these Terms to the extent of any inconsistency.


3. Quotations

Unless otherwise stated in writing:

  • quotations remain valid for thirty (30) days;
  • quotations are confidential;
  • pricing may change after expiry;
  • accepted quotations become binding once confirmed by both parties.


Additional work requested outside the quoted scope may incur additional charges.


4. Bookings

Bookings are confirmed only after:

  • acceptance of the quotation;
  • completion of any required agreement;
  • payment of any required booking fee.


Mac Imagery reserves the right to decline bookings where availability no longer exists.


5. Pricing

Unless otherwise stated:

  • all prices are quoted in Australian Dollars (AUD);
  • prices include GST where applicable;
  • pricing may change without notice prior to booking confirmation.


Confirmed bookings will not be affected by future pricing changes.


6. Online Galleries

Client photographs may be delivered through secure online gallery platforms.


Clients are responsible for:

  • maintaining the confidentiality of gallery passwords;
  • protecting download links;
  • downloading purchased images;
  • maintaining their own backups.


Mac Imagery cannot accept responsibility for unauthorised access resulting from passwords or gallery links shared by the Client.


7. Print Store

Mac Imagery offers professional-quality photographic products through its online Print Store.


Prints, albums, framed artwork and wall art are produced by carefully selected professional photographic laboratories.


Colour variations may occur between digital screens and printed products due to differences in screen calibration, display technology and printing processes.


Mac Imagery recommends purchasing printed products through the Mac Imagery Print Store to ensure the highest standards of colour accuracy, materials and archival quality.


8. Digital Downloads

Purchased digital images are supplied under the licence applicable to the purchased service.


The Client is responsible for downloading and backing up all purchased digital files.


Mac Imagery cannot guarantee ongoing access to online galleries beyond the published gallery availability period.


9. Intellectual Property

Unless otherwise provided by law or a separate written agreement:

  • all website content;
  • photographs;
  • logos;
  • branding;
  • graphics;
  • videos;
  • text;
  • downloadable resources;
  • marketing material;

remain the intellectual property of Mac Imagery.


Nothing contained within this website transfers ownership of intellectual property.


Image licensing is governed by the relevant Client Agreement.


10. Website Content

While every reasonable effort is made to ensure the accuracy of information published on this website, Mac Imagery does not warrant that all information is complete, current or free from error.


Information, pricing, packages and service descriptions may change without notice.


11. Third-Party Services

Mac Imagery may utilise trusted third-party providers to deliver aspects of its services, including:

  • online gallery platforms;
  • payment processors;
  • professional print laboratories;
  • cloud storage providers;
  • booking software;
  • mapping services;
  • website hosting providers.


Mac Imagery is not responsible for the availability, policies or operation of third-party services.


Clients should review the applicable terms and privacy policies of those providers where appropriate.


12. Feedback & Testimonials

Where a Client voluntarily provides a review, testimonial or feedback, Mac Imagery may reproduce that material for promotional purposes, including on its website, social media, marketing material and printed publications.


Testimonials may be edited for grammar, spelling or length without altering their intended meaning.


Clients may request removal of their testimonial by contacting Mac Imagery.


13. Acceptable Use

You agree not to:

  • use this website for unlawful purposes;
  • interfere with website security;
  • introduce malicious software;
  • copy website content without permission;
  • scrape, harvest or reproduce website content;
  • impersonate another person or business;
  • infringe the intellectual property rights of Mac Imagery or any third party.

Our website may contain links to external websites.


These links are provided for convenience only.


Mac Imagery is not responsible for the content, privacy practices or availability of third-party websites.


15. Australian Consumer Law

Nothing contained within these Terms excludes, restricts or modifies any rights or remedies available under the Competition and Consumer Act 2010 (Cth) or any other applicable Australian legislation.


Where goods or services supplied by Mac Imagery include consumer guarantees that cannot be excluded by law, those guarantees continue to apply.


16. Limitation of Liability

To the maximum extent permitted by law, Mac Imagery shall not be liable for indirect, consequential, incidental or special loss or damage arising from the use of this website or its services.


Mac Imagery's liability for any claim arising from goods or services supplied shall, where permitted by law, be limited to the resupply of those goods or services or the cost of having those goods or services supplied again.


Nothing in these Terms limits any liability that cannot legally be excluded.


17. Indemnity

You agree to indemnify and hold harmless Mac Imagery from any loss, damage, liability, claim or expense arising from your unlawful use of this website, breach of these Terms or infringement of the rights of another person.

22. Governing Law

These Terms are governed by the laws of the Commonwealth of Australia and the State or Territory in which the relevant dispute arises.


The parties submit to the exclusive jurisdiction of the Australian courts.
