Mac Imagery ("Mac Imagery", "we", "our" or "us").

These Online Store Terms & Conditions ("Terms") apply to all purchases made through the Mac Imagery website, including physical products, digital downloads, photographic prints, artwork, image licences and any other products offered for sale.

By placing an order through the Mac Imagery Online Store, you acknowledge that you have read, understood and agree to these Terms.

These Terms should be read in conjunction with the Mac Imagery Privacy Policy, Terms of Service and Copyright & Licensing Policy.

Products available through the Mac Imagery Online Store may include:

Fine Art Prints
Framed Artwork
Canvas Prints
Acrylic Prints
Metal Prints
Professional Photographic Prints
Albums
Photographic Products
Digital Downloads
Image Licences
Gift Vouchers
Other products made available from time to time.

Product availability may change without notice.

Mac Imagery reserves the right to discontinue or modify products at any time.

An order submitted through the Online Store constitutes an offer to purchase.

Orders are accepted only after payment has been successfully processed.

Mac Imagery reserves the right to refuse or cancel any order where:

payment cannot be authorised;
pricing errors occur;
products become unavailable;
fraudulent activity is suspected;
circumstances arise beyond our reasonable control.

Where an order cannot be fulfilled, any monies paid will be refunded.

All prices are displayed in Australian Dollars (AUD).

GST is included where applicable.

Mac Imagery reserves the right to amend pricing without notice.

Pricing changes will not affect completed purchases.

Payment must be received in full before:

digital downloads become available;
print orders enter production;
image licences become active.

Payments are processed through secure third-party payment providers.

Mac Imagery does not collect or retain credit card details.

Every reasonable effort has been made to accurately display photographs, colours and product descriptions.

However, due to variations between monitors, mobile devices and printers, colours may vary slightly from the finished printed product.

Website images are intended as a guide only.

Mac Imagery partners with a carefully selected professional photographic laboratory with over 80 years of printing experience.

Professional colour-managed workflows are used to produce premium-quality photographic products with exceptional colour accuracy and archival longevity.

For this reason, colours may differ from consumer printing laboratories.

Print products are professionally manufactured to order.

Production and delivery timeframes are estimates only.

Mac Imagery is not responsible for delays caused by:

production laboratories;
shipping providers;
customs;
public holidays;
severe weather;
events beyond our reasonable control.

Shipping costs are calculated during checkout unless otherwise stated.

Risk in physical products passes to the purchaser upon delivery.

If your order arrives damaged, please notify Mac Imagery within seven (7) days of delivery and provide photographs of the damaged packaging and product.

Mac Imagery will work with the production laboratory and shipping provider to resolve the issue as quickly as possible.

Digital products are licensed, not sold.

Upon successful payment, purchasers receive the licence applicable to the purchased product.

Digital files must not be:

redistributed;
resold;
sublicensed;
shared publicly;
altered contrary to the applicable licence.

Purchasers are responsible for selecting the licence appropriate to their intended use.

All photographs remain protected under the Copyright Act 1968 (Cth).

Purchasing a photograph, digital download or printed product does not transfer copyright ownership unless expressly stated in writing.

Purchasing a Fine Art print transfers ownership of the physical artwork only.

Unless otherwise licensed, Fine Art prints may not be:

copied;
scanned;
photographed for commercial reproduction;
reproduced in any format;
commercially exploited.

Certain digital products are supplied under specific licences, including but not limited to:

Personal Use Licence
Web Licence
High Resolution Licence
Commercial Licence
Extended Commercial Licence
Exclusive Licence

The permitted use of each image is governed by the licence purchased.

Additional licensing may be obtained by contacting Mac Imagery.

Due to the custom nature of photographic products, Mac Imagery does not accept returns or provide refunds for change of mind.

Where products arrive damaged, defective or materially different from the approved order, Mac Imagery will provide an appropriate remedy in accordance with the Australian Consumer Law.

Digital downloads cannot be returned or refunded once access has been granted, except where required by law.

Gift vouchers:

are not redeemable for cash;
are non-refundable;
may only be used for Mac Imagery products and services;
remain subject to any expiry date stated at the time of purchase, where permitted by law.

To the maximum extent permitted by law, Mac Imagery shall not be liable for indirect or consequential loss arising from purchases made through the Online Store.

Nothing contained within these Terms excludes any consumer guarantees that cannot lawfully be excluded under Australian Consumer Law.

Personal information collected through the Online Store is managed in accordance with the Mac Imagery Privacy Policy.

Mac Imagery reserves the right to amend these Terms at any time.

Updated versions will be published on the website and become effective from the published Effective Date.

These Terms are governed by the laws of the Commonwealth of Australia.

Any disputes shall be determined in accordance with the laws applicable within the relevant Australian jurisdiction.
